<div style="text-align: justify;">Miami and Dade County businesses that fall under the umbrella of one of the many federal regulations that mandate security of confidential and personal data reportedly have spent a great deal of time and money in an attempt to ensure compliance with these laws.   Experts caution the general public, however, that their personal information may still be vulnerable to unauthorized access despite these efforts, due to the fact that local businesses may not have the safety of the public as the top priority.   Survey results indicate that most companies cite fears concerning violations and/or compliance with federal privacy laws such as HIPAA (Health Insurance Portability and Accountability Act), HITECH (Health Information Technology for Economic and Clinical Health Act), FACTA (Fair and Accurate Credit Transactions Act), and GLBA (Gramm Leach Bliley Act) as the chief reason for establishing guidelines for data security.  In addition, according to a recent article in PC World magazine, &#8220;…it is possible to meet the minimum requirements for compliance without being truly secure, especially when ⌠companies⌡ have to deal with multiple, overlapping directives.&#8221;  The article goes on to relate how businesses that must meet the minimum requirements for multiple regulatory mandates face an even greater struggle, as they attempt to comply with all of these privacy laws – in addition to other legislation which may have been established at the state level.</div>

<div style="text-align: justify;">I recently read a news item concerning the rising problem of identity theft among college students, which made me curious.  Although like many other south Florida residents, I was aware that the rate of identity theft in this region has been steadily increasing, I must confess that it never occurred to me that college students were particularly vulnerable to this type of crime.  For some reason, I think of an identity thief targeting an older person, someone that looks prosperous (i.e. drives an expensive car, wears designer clothes, carries a lot of cash or credit cards, etc).  As the mother of a college student that does not fit any of these criteria, I was much more concerned about the traditional problems that students face – such as drinking, partying, and engaging in the wonderfully irresponsible behavior that only comes with youth and immaturity.</div>
<h1 style="text-align: justify;"><span style="font-size: medium;">Identity Theft Among College Students in Miami</span></h1>
<div style="text-align: justify;">According to data released by the United States Federal Trade Commissions, Florida had more reported incidents of identity theft than any other state last year.  Although this statistic alone is enough to give anyone living in the Miami and Dade County area pause, it can be especially frightening for parents of college students, who have been shown to be not only vulnerable but surprisingly indifferent to this very real threat.  This vulnerability can manifest itself in a number of ways.  For example, a recent news item featured on the Minnesota-based Star Tribune East Metro website reported that ECMC, a company that processes nationwide student loans, reported a major theft of &#8220;personally identifiable information&#8221; involving 3.3 million students following a break-in at its Oakdale headquarters.  Company officials believe it could be one of the biggest cases of student identity theft in the country, affecting approximately 5 percent of all students with federal loans in the United States.   Another way that thieves target college and university students is through credit card offers in the mail.  Impulse Research for Chubb Group Insurance Companies conducted a nationwide survey of college students for identity theft research purposes a few years ago and discovered that 49 percent of today&#8217;s college students receive frequent applications for credit cards, while 30 percent of those college students throw the applications away in their original condition &#8211; with all the personal data intact.  Adding insult to injury is the fact that, according to the survey results, nearly 30 percent of college students ignore their checking account and credit card balances.  College students should be strongly encouraged to keep track of their funds, which will ultimately make it much more difficult for identity thieves to succeed.</div>

<p style="text-align: justify;">As I travel around Miami and Dade County and observe the variety of ways that data and records management systems are maintained by businesses, I am amazed at just how ignorant many companies are with regard to this issue.  For example, I recently witnessed a retail store employee throw a stack of credit card receipts in the trash – without shredding them or even bothering to tear them up.  Concerned, since I am a frequent patron of this particular location, I reported the incident to management, who assured me that this was an exception rather than the rule and that the employee would be dealt with according to their specific policy, leaving me with little choice but to place my trust in their &#8220;system&#8221; and hope that my credit card number will not be among the next group that is disposed of &#8220;in error&#8221; by an employee who has not been trained in how to handle sensitive and confidential data.</p>
<h1 style="text-align: justify;"><span style="font-size: medium;">Reducing Identity Theft in Miami</span></h1>

<p style="text-align: justify;">According to recent research results, small businesses seem to be suffering a disproportionate amount of damage with regard to data and security breaches.  This survey, conducted by the Identity Theft Resource Center, stated that out of the  226 of these breaches from 2011 that were examined, approximately 44% of the victims were businesses that listed their assets at under $35 million.  Although monetary claims and damages are much higher for big businesses that experience data breach incidents, such as the recent Sony and Verizon data breaches which involved millions of dollars each, experts seem most concerned about the vulnerability of small businesses for a variety of reasons.  Miami and Dade County are particular areas of concern for authorities due to the high incidences of medical identity theft that have been reported in the region.</p>
<h1 style="text-align: justify;"><span style="font-size: medium;">Document Destruction and Small Businesses</span></h1>

<p>Data breaches and unauthorized access to confidential information have become one of the leading contributors to identity theft, according to officials and information technology security experts.  To put this into perspective, those of us who fifteen years ago rushed out and bought portable paper shredders and cut up credit cards and old bank statements in an attempt to ward off the threat of &#8220;dumpster divers&#8221; must now worry about our personal information being exposed in ways for which we have no control.  Although many Miami and Dade County businesses have established disk-encryption and other various methods for their office computers and networks, designed to protect their customers and themselves from their data being stolen, little has been done by these same companies to similarly safeguard the portable storage devices being used by their employees.</p>
<h1 style="text-align: justify;"><span style="font-size: medium;">Data Destruction and Portable Storage Devices</span></h1>
<p style="text-align: justify;">For example, let’s examine these recent examples provided by the Privacy Rights Clearinghouse:</p>
<p style="text-align: justify;">a)	Personal information for approximately 878 patients of University of Kentucky Healthcare in Lexington, Kentucky was exposed after an employee’s cellular phone was either lost or stolen in September of 2011.  The phone contained not only clinical data, but also medical record numbers and names, although it has been confirmed that no Social Security numbers or financial data was accessed.</p>
<p style="text-align: justify;">b)	An unknown quantity of physician and patient information from Virtual Radiological Professionals was compromised when an employee’s laptop computer was stolen from a car in Eden Prairie, Minnesota.  Data included not only names and addresses, but also Social Security numbers, bank account numbers, credit card numbers, and some clinical data.</p>
<p style="text-align: justify;">c)	Officials in Tampa, Florida state that the data from an unknown quantity of patients was made vulnerable following the November, 2010 theft of a camera, several laptops, and several &#8220;thumb drives&#8221; from the James A. Haley VA Hospital.  All of these items are believed to have contained Social Security numbers, graphic photos of female breast cancer patients, and other data.</p>
